On April 24, I had the pleasure of speaking with some colleagues at the Mexican Consulate about immigrant rights during the COVID Pandemic.

At Lincoln-Goldfinch Law, we understand that the COVID-19 pandemic has affected us all in different ways, but especially, we have observed how the rights of immigrants can be harmed, that is why in this opportunity we had the pleasure to answer some of the most frequently asked questions, so that the community is aware of their rights and how they can apply to certain legal tools available to them.

The questions they asked us were:

Is ICE still detaining people despite the COVID-19 contingency?

We will not say that it works on a regular basis, but indeed, they continue to detain immigrants, ICE previously announced that it was only going to focus on detaining people who may pose a high risk to the country.

What should I do if ICE comes to my home or workplace? What are my rights?

The rights of immigrants detained by ICE or immigration agents must remain intact, regardless of whether there is a pandemic or not, ICE needs a warrant to enter your home or workplace.

Are the immigration courts still open?

The vast majority of the hearings have been postponed due to the current health situation in the country, which may affect the timing of the immigration process.
