Plan C Immigration Reform
This week we are waiting to see if the "Plan C" Immigration Reform will pass in the Senate as part of the Build Back Better plan.
This is called Plan C because it was the third option for the Biden Administration to provide some sort of relief or amnesty in legislation. It proposes a ten year work permission for undocumented immigrants who have been here for 10 years. Those eligible will be provided with parole and permission to work in the United States. Nothing is final yet, but for those who want to take action, a key thing to do now to qualify is start gathering evidence of your physical presence in the U.S. for the last 10 years.
This could be school records. medical records, bank statements, phone records, lease agreement, mortgage, etc. Anything that is a receipt with your name, location and the date will work. It can take some time to put this evidence together so it is a good idea to get started now.
If the legislation passes, other evidentiary requirements will become clear, and we will keep you posted on how that develops. We are hoping that this legislation passes the way that it is proposed.
Thanksgiving Travel
If you’re undocumented and you’re planning to travel by car or by plane in the U.S., beware of the risks.
One thing to know is that the enforcement priorities that are in place right now, as a general policy, only affect undocumented immigrants with serious crimes on their record. However, every ICE officer makes their own determinations, so there’s no way to tell who will want to place someone in deportation proceedings or not. You can encounter border patrol in international and domestic/interior airports. Road tripping is equally risky because you could be pulled over as a driver or passenger in a remote, rural area that may not be friendly to immigrants.
If you have questions about your particular case, please reach out to us. We offer free consultations and we can help you decide whether or not it is risky to travel.
Happy Thanksgiving!
