You are receiving this email because you have hired Lincoln-Goldfinch Law – Abogados de Inmigración to help you with your DACA Advance Parole case. Thank you for trusting us with this incredibly important matter.
DACA Advance Parole can be granted for three reasons: humanitarian, employment or education.
If you have a sick family member, have been accepted into a study abroad program, or need to perform required work duties abroad, then we can pursue DACA Advance Parole through any of these reasons.
When pursuing this process, your Legal Team will be trying to prove to immigration as to why you should be granted Advance Parole through DACA.
The types of documents we will need will depend on what type of case we are doing for you.
If you are traveling because you have a Humanitarian need, a sick family member, we will need to show your relationship with that person. Most likely, this will involve your birth certificate that has that family member’s name on it as well, or if it’s a grandparent, your birth certificate and your parent’s birth certificate that show the sick individual’s name. We’ll also need to show their medical conditions, so we will need a letter from their doctor, their prognosis, and why it is that this family member needs you with them. We will also need to provide dates, if there are any specific dates you need to travel, for surgeries and such.
If you are traveling for Education purposes, we will need to show proof that you have been accepted into a study abroad program and that it is necessary for your degree plan.
If you are traveling for Employment purposes, we will need a letter from your employer stating why it is necessary for you to go out of the country in order to complete the specific work tasks you have been assigned. Perhaps you need to attend a conference, or train an individual abroad, for instance.
These grants of Advanced Parole only give you permission to travel one time. You can’t use them for coming in-and-out purposes.
You will be given dates, and you have to make your travel within that certain time frame, leaving after the first date, and coming back before the second. You will also need to be sure that your travel document is stamped whenever you come back into the United States.
You are going to need a valid passport, so if your passport is getting close to expiring, now is a good time to go ahead and renew it.
USCIS may ask you to do your updated biometrics, but probably not. DACA recipients have to do their biometrics so often that USCIS will probably use the most recent ones you’ve already submitted.
Some of the benefits of DACA Advance Parole is that it counts as a legal entry. So, if you otherwise qualified to Adjust your status, say you are married to a US citizen, then you can now do it from within the US without having to leave, and do your consular interview abroad.
